Judges appointed by the Crown had the task of welding together a system of law applicable (and therefore common) to the country as a whole. This law gradually emerged from principles developed and applied to cases which came before the courts. Common law in this context means judge-made law. Case law and statute law as opposed to principles of equity The civil law sometimes allows the court to exercise discretionary powers, which are based not just on the legal rights of the parties, but on what will produce a just and moral solution.
