21 A duty of care that is grounded in the law may offer a statutory method of obligating businesses to take responsibility for uncertainty. Business owners enjoy the benefits of the opportunities and often have (or could have) the most accurate view of the threats. That means reversing the burden of proof: businesses must demonstrate that they are acting responsibly, while government is no longer obliged to demonstrate a threat to physical safety. In other words, a duty of care does not necessarily lighten the load.
6 A report by the Health Council of the Netherlands concerning Legionnaires’ disease (2003) is a good example. In 1999, an outbreak of Legionellosis at a flower show in the Netherlands affected 188 visitors and exhibitors and led to 28 deaths.
